These Terms of Use ("Terms") govern your access to and use of the website at jakeporter.daringventures.com and any other websites, pages, or online services we operate that link to these Terms (together, the "Site"). The Site is operated by Daring Ventures Counseling, Coaching, and Consultation, LLC ("Daring Ventures," "we," "us," or "our").

Please read these Terms carefully. They form a binding agreement between you and Daring Ventures.

1. Acceptance of These Terms
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

2. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the current version on this page. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms, so we encourage you to review this page periodically.

3. Who May Use the Site
The Site is intended for users who are at least 18 years old and located in the United States. By using the Site, you represent that you are 18 or older. We make no claim that the Site or its content is appropriate or available for use outside the United States.

4. Educational Purpose Only — Not Therapy or Professional Advice
All content on the Site — including articles, blog posts, webinars, workshops, e-books, videos, audio, downloadable materials, and similar resources — is provided for general educational and informational purposes only.

Using the Site does not create a therapist–client, counselor–client, coaching, or other professional relationship between you and Daring Ventures or any of its clinicians or staff. The Site is not a substitute for individualized advice from a qualified professional, and its content should not be used to diagnose or treat any health or mental-health condition. Always seek the advice of a licensed professional regarding any medical, psychological, or personal question you may have, and do not disregard or delay seeking professional advice because of something you read on the Site.

5. No Emergency or Crisis Services
The Site is not designed for, and must not be used for, medical or mental-health emergencies, and it is not monitored for crisis communications. If you are experiencing a crisis, having thoughts of harming yourself or others, or facing any emergency, call 911, go to your nearest emergency room, or call or text 988 to reach the 988 Suicide & Crisis Lifeline.

6. Relationship to Clinical, Coaching, and Consultation Services
These Terms govern only your use of the Site. If you engage Daring Ventures for therapy, coaching, consultation, or other professional services, those services are governed by the separate consent forms, service agreements, and policies you receive and sign for them. Nothing on the Site, and nothing in these Terms, modifies or replaces those separate agreements.

7. Intellectual Property
The Site and its content — including text, graphics, logos, images, course materials, downloadable documents, and the selection and arrangement of that content — are owned by Daring Ventures or its licensors and are protected by copyright, trademark, and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and view the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, sell, or create derivative works from any part of the Site, and you may not remove any copyright or proprietary notices, without our prior written permission. "Daring Ventures" and our logos are our trademarks and may not be used without permission.

8. Purchases and Digital Products
The Site may allow you to purchase or download products and services, such as e-books, recorded or live webinars, workshops, courses, and other materials ("Products").

Payment. Prices are shown at the point of purchase and may change. Payments are handled by a third-party payment processor; we do not store full payment-card numbers. Please do not send payment-card information by email.

License to Products. Unless stated otherwise at the time of purchase, Products are licensed to you for your own personal, non-commercial use only. You may not share, resell, redistribute, or publicly display a Product, or remove any copyright or proprietary notices.

Downloads. You download materials at your own risk. We do not warrant that downloads will be error-free or continuously available.

Refunds. Refunds, if any, are governed by the terms stated at the point of purchase.

9. Your Account
Some features or Products may require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please provide accurate information, keep it current, and notify us promptly of any unauthorized use.

10. Acceptable Use
When using the Site, you agree not to:

use the Site in any way that violates applicable law or these Terms;
post or transmit content that is unlawful, infringing, defamatory, harassing, abusive, hateful, or invasive of another person's privacy;
attempt to gain unauthorized access to the Site, other users' accounts, or our systems;
interfere with or disrupt the Site, or introduce viruses or other harmful code;
use the Site to collect or harvest information about other users; or
scrape the Site or use automated means to access it, except as expressly permitted.

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms.

11. Comments and User-Submitted Content
The Site may let you submit comments or other content (for example, on our blog). You are solely responsible for content you submit, and you represent that you have the right to submit it and that it does not violate these Terms or the rights of others.

By submitting content, you grant Daring Ventures a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content in connection with operating the Site. We may — but are not obligated to — review, edit, or remove user-submitted content at our discretion. Please do not submit confidential, sensitive, or personal health information through public features of the Site.

12. Third-Party Links and Content
The Site may contain links to third-party websites, products, or resources. We provide these for convenience only and do not control, endorse, or take responsibility for third-party sites or their content, products, or practices. Accessing third-party sites is at your own risk, and their terms and privacy policies — not ours — apply.

13. Disclaimers
The Site and all content and Products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We work to provide accurate, current information, but we do not warrant that Site content is accurate, complete, reliable, or error-free. Research and professional knowledge evolve, and content may become outdated.

Testimonials and results. Any testimonials or success stories on the Site reflect the individual experiences of specific clients or colleagues and are shared for illustration only. They are not a promise or guarantee that you will achieve the same or similar results. Outcomes from therapy, coaching, consultation, courses, or other Products vary based on many factors, including each person's circumstances and effort, and we do not guarantee any particular result.

14. Limitation of Liability
To the fullest extent permitted by law, Daring Ventures and its owners, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of — or inability to use — the Site, its content, or any Products.

To the fullest extent permitted by law, our total liability for all claims relating to the Site or these Terms will not exceed the greater of (a) the total amount you paid us, if any, for the Product or Site access giving rise to the claim during the [12] months before the claim, or (b) USD $100.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. This Section addresses your use of the Site only; it does not address or limit any liability arising from professional services, which are governed by the separate agreements described in Section 6.

15. Indemnification
You agree to indemnify and hold harmless Daring Ventures and its owners, officers, employees, and contractors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

16. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle information. How protected health information is handled in connection with clinical services is addressed separately in our Notice of Privacy Practices.

17. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Site that is not otherwise resolved will be brought exclusively in the state or federal courts located in Chambers County, Texas, and you consent to the jurisdiction of those courts.

18. General
Entire agreement. These Terms, together with the Privacy Policy and any terms presented at the point of purchase, form the entire agreement between you and Daring Ventures regarding your use of the Site.

Severability. If any provision is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be applied as nearly as possible to its original intent.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
